La decisi\u00f3n se debe, explican, a la reciente explosi\u00f3n de la popularidad de ChatGPT y GPT-4, que ha generado una oleada de aplicaciones falsas.\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Para <strong>Javier Velilla<\/strong>, socio director de <strong>Comuniza<\/strong>, \u201ccuando se trata de marcas gen\u00e9ricas, los derechos de propiedad intelectual pueden ser limitados y los propietarios de marcas pueden enfrentar dificultades para registrarlas\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En t\u00e9rminos legales, una marca gen\u00e9rica es aquella que se refiere al nombre com\u00fan de un producto o servicio. Por ejemplo, \u00abcomputadora\u00bb o \u00abrefresco\u00bb son t\u00e9rminos gen\u00e9ricos. En general, y teniendo en cuenta este contexto,<strong> no se podr\u00edan registrar marcas gen\u00e9ricas porque no identificar\u00edan de manera distintiva el origen de los productos o servicios en cuesti\u00f3n.<\/strong><\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cCuando nos encontramos con un vac\u00edo legal, aparecen algunas excepciones. En algunos casos, <strong>se puede obtener el registro de una marca gen\u00e9rica si se ha utilizado de manera extensiva y se ha convertido en una marca distintiva<\/strong>\u201d, informa Velilla. Y finaliza: \u201cUn ejemplo en Espa\u00f1a es Cola Cao: es un t\u00e9rmino gen\u00e9rico utilizado para describir una bebida de cacao similar, que ha logrado obtener el registro de la marca debido a su uso extensivo y reconocimiento distintivo en el mercado espa\u00f1ol.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El caso de OpenAI se enfrenta a algunos obst\u00e1culos para obtener el registro de la marca debido a su naturaleza gen\u00e9rica. Sin embargo, si han utilizado la marca de manera extensiva y ha adquirido un significado distintivo en la industria de la inteligencia artificial, es posible que puedan
